Health Canada Issues Notice of a Proposal to Amend the Cosmetic Regulations

On July 16, 2021, Health Canada issued a Notice to Interested Parties about a Proposal to amend the Cosmetic Regulations.
According to the notice, the Proposal is open to pre-consultation from July 16 to August 30, 2021.

What is a pre-consultation?

A pre-consultation is one of the preliminary steps of an amendment and serves as a means to gather comments from all affected and interested parties for feedback on the Notice to Interested Parties.

What are the proposed amendments?

The following amendments being proposed by Health Canada are:

  1. Adding a requirement to disclose specific fragrance allergens on cosmetic labels
  2. Allowing flexibility for the disclosure of ingredients and specific fragrance allergens on labels of small packages
  3. Improving oversight of cosmetics by:
    a. Clarifying terminology and improving the level of detail of information submitted during a cosmetic notification to facilitate its use for risk management purposes; and,
    b. Enhancing compliance and enforcement oversight with regard to who responsible for responding to evidence of safety requests for cosmetics
  4. Addressing administrative updates

Who can participate:

While the notice is addressed to “interested stakeholders”, this pre-consultation is open to the general public.
